These are the terms and conditions which apply to your subscription with Faraday Research (“Faraday”) and your use of the website and mobile phone application(s) provided by Faraday.
By using our services you agree to be bound by these terms and conditions and they shall constitute a legally binding agreement between you and Faraday (the "Agreement"). We may make minor changes to our terms and conditions (a) to reflect changes in relevant laws and/or regulatory requirements; and (b) to implement minor technical adjustments and improvements. If we do, we will publish our updated terms here. In addition, we may make more significant changes to our terms and conditions: (a) to make them clearer or more favourable to you; (b) to reflect changes in market conditions; or (c) to reflect changes in the way we do business. If we do, we will notify you in writing of the changes. If you object to any such change, you must tell us within 14 days of the date you receive the notice. If you give us notice that you object, the changes will not be binding on you but we may require you to close your account with Faraday. If you do not object, you will be deemed to have accepted the change(s). Trade Facts Ltd, trading as Faraday Research, is part of the GAIN Capital group of companies. We provide investment research to private investors.
Faraday provides research on equity and FX markets with trade ideas offering entry and exit price targets based on technical and fundamental analysis. Faraday, in its sole discretion, will determine the content and volume of its research based on the prevailing market conditions at the time of publication.
3. Research and Information
The research and information provided by Faraday, whether provided on the Faraday website, our mobile application(s) or otherwise are not intended to constitute an offer or solicitation with respect to the sale or purchase of any security or financial product. The research and information provided is prepared for general information only, and as such, your specified needs or personal circumstances, including your investment objectives, risk profile, knowledge and understanding or financial situation have not been taken into consideration. Individuals should therefore discuss with their financial planner or advisor the merits of each recommendation for their own specific circumstances and should fully understand that not all investments will be appropriate for all investors or potential investors. Faraday’s research and information are not intended to and do not constitute investment advice or an investment recommendation.
Partners, employees and/or affiliates of Faraday may hold one or more of the positions in markets reviewed by Faraday, to the extent permitted by the FCA Rules. These holdings should not be seen in any way as a recommendation.
4. Access to Site and Premium Content
Access to some content (“Premium Content”) on the Faraday website and mobile application(s) is restricted. To access such content on the Faraday website or mobile application(s), you are required to hold a valid subscription to one or more Faraday products. If you have such a subscription, you will be provided with a username and password to access the Premium Content. The extent of Premium Content provided to you is dependent on the Faraday products to which you have subscribed.
5. Use of Site and Reproduction of Content
The research and information provided by Faraday, whether provided on the Faraday website, mobile application(s) or otherwise, and including, but not limited to, Premium Content, is meant for personal use by individual visitors and users, and may not be used for any other purposes. Further disclosure, distribution, reproduction or redistribution of this information, regardless of whether it is or is not meant for commercial purposes, by any form of media, is prohibited without prior written approval of Faraday. Any reproduction, copy, multiplication, transfer or hypertext link, in any way, of a part or of the whole of the information on this site is subject to Faraday’s written approval in advance. Faraday reserves all rights and remedies that may be available to it in the event of a breach of this Agreement.
Access to Premium Content is strictly limited to Faraday subscribers only. You agree that if you disclose, distribute or reproduce any Premium Content without the prior written consent of Faraday, or disclose your log-in details to another person, you will be liable to pay the monthly subscription price for each party who is provided with the means to access the Premium Content or to whom such information is disclosed (regardless of whether such Premium Content is actually accessed by such party).
6. Limitation of liability
We do everything in our power to ensure that our website and mobile phone application(s) are fully operational and available to you at all times, but we cannot guarantee that these services will be available at all times, whether due to scheduled maintenance, unscheduled interruptions or other reasons.
Whilst Faraday has taken reasonable steps to verify the reliability of the views and recommendations expressed in the reports published on its website and mobile application(s) and to ensure such information is correct and up to date, Faraday and its third party suppliers do not offer any warranty or guarantee as to the accuracy or completeness of such information.
To the extent permitted by law, Trade Facts Ltd and its employees, agents, authorised representatives and third party suppliers exclude all liability for any loss or damage (including indirect, special or consequential loss or damage) arising from the use of, or reliance on, any research or information provided by Faraday, whether provided on the Faraday website, mobile application(s) or otherwise and whether or not caused by any negligent act or omission. To the extent Faraday’s liability is not excluded, Faraday hereby limits its liability, to the extent permitted by law, to the re-supply (or the cost of re-supply) of the information on the website or mobile application.
7. Complaints Procedure
Faraday is fully committed to providing a high standard of service to all our Clients on every occasion. As part of that commitment we have in place an internal complaints handling procedure to ensure that any complaints received from our Clients are handled fairly, effectively, promptly and in accordance with the relevant complaint handling requirements applicable to us as a UK regulated firm under the Financial Conduct Authority and Financial Ombudsman Service complaint handling rules.

8. Subscriptions and Subscription Fees
To access Faraday’s services (including Premium Content), you must apply to subscribe for one or more products on the Faraday website (“Subscription”) and make your first and subsequent monthly payments as set out below (“Subscription Fee”).
To apply, you must go to the subscription page on our website or mobile application, provide the information marked as “Mandatory” (which will include your payment details) and select the payment option for the price quoted at the time of your application. If Faraday accepts your Subscription application, you will then receive a confirmation email from Faraday indicating that Faraday has accepted your Subscription and you will then be able to access the Premium Content. Subject to paragraph 9 below, payment will be taken using the card you registered in your application after the end of the 14 day Free Trial Period (see paragraph 9 below). Please note, your first monthly subscription payment will be taken on the 16th day following the date on which your free trial commenced, however should this day fall on a Saturday or Sunday your payment will be taken on the subsequent Tuesday (Wednesday in the event of a bank holiday). Whatever date within a calendar month this day falls on will then be your future Payment Date for subsequent payments (unless you cancel your subscription as per paragraph 9 below. If Faraday does not accept or cannot process your application for any reason, you will be notified by e-mail.
Your Subscription will commence on the date of confirmation of acceptance of your application and continue on a rolling monthly basis unless and until cancelled in accordance with paragraph 9 below. Your first monthly payment will be due immediately after the end of the Free Trial Period and each subsequent payment will be due on each monthly anniversary thereafter (each a “Payment Date”).
Unless you cancel your Subscription at least two business days before a Payment Date, you authorise us to charge your next month's Subscription Fee to your registered payment card on each Payment Date.
In the event that your payment card details should change, you must inform us of your updated card information at least two business days before your next Payment Date, during Monday to Friday and by 5pm.
Should we be unable to take payment of your Subscription Fee for any reason, we will try to contact you via SMS, email and/or phone to either take payment over the phone and/or set up your new payment card. If we are unable to contact you within five days of the relevant Payment Date, we reserve the right to cancel your Subscription at our sole discretion.
All prices quoted on the www.faradayresearch.com website for Faraday reports are quoted in GBP.
Faraday has used reasonable endeavours to ensure that prices for Subscriptions to Faraday services are published accurately on the website but these prices are subject to change and Faraday reserves the right to change these prices without prior notice at any time. Prices charged and payable will be those quoted at the time you completed your Subscription application.
If you subscribe for one of our products, you will be sent an email which confirms receipt of your order. It will not contain the payment details provided by you.
In the event that a subscribed product is discontinued during your Subscription period, no pro rata refunds will be given. However, an alternative Faraday product will be provided to you of a value equal to or more than the residual value of the discontinued product.
9. Free Trial Period and Cancellations
Member satisfaction is important to us, and we understand that our service will not suit everyone’s needs. Accordingly all new subscribers are entitled to a 14 day free trial period (the “Free Trial Period”) during which you may cancel your Subscription. Cancellations must be received at least two business days before a Payment Date and by 5pm Monday to Friday.
If you wish to cancel your Subscription after the end of the Free Trial Period, you must notify us at least two business days prior to your next Payment Date. Cancellation notifications must be received by us by 5pm (UK) Monday to Friday. If we do not receive notice of your cancellation by this deadline and within these business hours payment of your Subscription Fee will be taken on or following the next applicable Payment Date.
In the event that we (in our absolute discretion) agree to a refund or partial refund of your Subscription Fee we will use all reasonable endeavours to process this refund or partial refund within 5 business days of agreeing to it, during which time the funds concerned will remain our property and will not become your property until received by you.

Please note, that without exception, no refunds or partial refunds shall be made after you have made a payment. Once your Subscription has been cancelled, all alerts and access will be suspended 24 hours prior to the end of your final subscribed month.
We reserve the right to terminate this Agreement at our sole discretion and without reason or notice.
In providing our services, we will treat you as a retail client for the purposes of Financial Conduct Authority client classification rules. This Agreement shall be governed by and construed in accordance with English law and you hereby agree to be subject to the exclusive jurisdiction of the courts of England.
